Wage Loss Replacement through Temporary Disability Benefits

If you’ve been involved in a workplace accident that resulted in personal injury and disability, you may be entitled to wage loss replacement through temporary total or temporary partial disability benefits under Iowa workers’ compensation law. Temporary Total Disability 

A Des Moines worker who qualifies for workers’ compensation may be eligible for temporary total disability if an injury results in more than three days of disability. In the case that you are disabled to the point of not being able to perform any work duties, you may receive temporary total disability benefits beginning on the fourth day of your disability. 

When you are capable of returning to your previous position or acquiring a new working position with equivalent salary, your disability benefits will cease or change. Temporary total disability benefits are for those wholly unable to perform any workplace duties because of injury. 

Temporary total disability pays 80% of the worker’s weekly spendable earnings. In the case that the temporary total disability period exceeds 14 days, the three-day waiting period that was previously unpaid will become payable. 

Temporary Partial Disability 

As opposed to temporary total disability, temporary partial disability is sometimes granted to employees who can perform some workplace functions, and are given a lower wage than previous as a result. 

For example, if a worker suffered a physical injury that results in the employee no longer being able to put in the same hours of work per day, or if the employee is still working but at a less physically demanding task that results in a lower wage, he or she may be entitled to partial disability benefits. 

In the case that a worker is eligible for temporary partial disability, he or she will be entitled to two-thirds, or 66.7%, of the difference between the employee’s gross income at the time of injury and the employee’s gross income after the injury while working at a lower paying job. 

For example, if the employee was making $200 a week and is now only making $150, he or she would be entitled to 66.7% of the difference of $200 and $150, or about $33 per week (66.7% of $50) in disability benefits. 

Permanent Disability Benefits 

Similar to temporary total disability, the three-day waiting period after the injury applies. If the employee is permanently disabled but can still work, he or she may be entitled to permanent partial disability. If the employee is permanently disabled and cannot work, he or she may recover permanent total disability
